How does McKinney-Vento help students and families?
The law makes sure that students in temporary living arrangements receive a free and suitable public education by removing barriers to school enrollment and full, basic, daily participation in school activities. This includes:
- Immediate enrollment
- Help from school with any necessary enrollment documents
- Help from school with basic high school graduation needs and expenses
- Helps connects students and families with local resources
- Emotional support
Who is protected under McKinney-Vento?
McKinney-Vento uses the term “Homeless, which" is defined as “anyone lacking a fixed, adequate, regular nighttime residence.” What situations fit this definition?
- Staying in the home of other people due to unavailable housing, financial hardship, or similar circumstances
- Living in motels, hotels, trailer parks (in some instances – examples: leaking roof, no heat, etc.), public places, or campgrounds due to unavailable suitable housing options
- Living in an emergency shelter or transitional housing
- Unaccompanied (not living in direct care of legal parent or guardian) or runaway youth
- Refugee and migrant youth

Students who are experiencing unstable housing are also granted special rights under the act. As a homeless youth or youth in a temporary living arrangement, you have the right to:
- SCHOOL STABILITY – To remain enrolled in, and be transported to a student’s School of Origin when feasible, even if a student moves outside of the district. (‘School of Origin’ means the school last attended when permanently housed, or the school in which the child or youth was last enrolled).
- IMMEDIATE ENROLLMENT – To be enrolled immediately (even without medical or school records) in the neighborhood school.
- ASSISTANCE WITH BARRIERS – To have barriers addressed so that they can participate in all school activities (this could include having certain school fees waived).
- ACADEMIC SUPPORT – To ask for academic support if a student is struggling with classwork. Parents or guardians should contact school staff for assistance.
- DISPUTE RESOLUTION – To use the school district’s Dispute Resolution Process to appeal a school’s decision when there is a disagreement about school selection or enrollment.
